zu Beginn dieser Woche wird auch in der bundesdeutschen Presse darüber berichtet, von Focus bis zum Spiegel.

Dabei sind die hinter diesen Aussagen stehenden potenziellen Vorwürfe alles andere als neu: auch darüber ist schon in den einschlägigen Gazetten berichtet worden.

Und in Vergessenheit können diese Vorwürfe auch noch nicht geraten sein, nachdem die Muttergesellschaft erst 2007 mit dem offiziellen Start in den USA beginnt. [1]

Das Ganze kulminiert in der Frage nach der Gültigkeit oder Brüchigkeit des sogenannten Privacy Statements in der Fassung vom 30. April 2012 [2]

nun wirklich zu bedeuten?

Dazu ein Hinweis auf die China Daily Mail vom 6. Juni 2012 und dem Artikel: "China’s counter attack will be horrible, says Chinese military leader".

Die gleiche Zeitung hatte bereits in der Woche vor der Veröffentlichung dieser Untersuchung reagiert und am 6. Oktober 2012 einen Text unter der Überschrift "US House Intelligence panel claims China’s Huawei is spying" publiziert.

Interessant, was die gleiche Gazette über den Einspruch der Australier am 23. Mai 2012 in diesem Zusammenhang zu sagen hatte: "Australian government blocks China’s Huawei".

1. Personal Information that HUAWEI Collects.

• Personal Information You Submit. HUAWEI collects personal information when you submit it to the Site (for example when you participate in promotions, contests or surveys or when you email product descriptions to friends). The personal information collected may include your name, birth date, address, mobile, phone, or fax number, email address, account information (such as account and online registration), online activities, and other specific personal information. In some cases, the personal information HUAWEI asks you to provide will be mandatory to participate in a particular activity, service or promotion. If you do not provide this personal information, your participation in that activity, service or promotion may be limited or prohibited.
• Automatically Collected Personal Information. HUAWEI collects certain types of personal information automatically when you visit the Site. For example, when your web browser accesses the Site, HUAWEI obtains certain types of personal information, such as your IP address, browser type and the page you visited before visiting the Site. HUAWEI stores and uses certain information from your browser using “cookies” and other mechanisms. A "cookie" is a small data file that the Site transfers to your computer for storage to allow HUAWEI’s server to "remember" specific personal information. HUAWEI may use "cookies" and other tracking mechanisms to help support the integrity of registration processes on the Site, to retain changes that you made, and to track marketing efforts. HUAWEI also allows third party service providers to collect information to help HUAWEI track aggregate and individual use of the Site. You may be able to disable some cookies by modifying your browser preferences. 2. HUAWEI’s Use of Personal Information.

HUAWEI uses the personal information it collects to operate and improve its web sites, business, products and services. These uses may include providing you with more effective customer service, making sites or services easier to use by eliminating the need for you to repeatedly enter the same information, performing research and analysis aimed at improving HUAWEI’s business, products, and services, and detecting fraud and abuse. Also, HUAWEI may use your personal information to communicate with you. HUAWEI may send service communications such as welcome emails, information on technical service issues, and security announcements. HUAWEI may also occasionally send you product surveys or promotional mailings to inform you about other products or services available from HUAWEI, and to fulfill promotions. Personal information collected through the Site may be stored and processed in the United States. By using the Site, you consent to the transfer of information outside of the country where you reside.

3. Sharing Personal Information.

Except as described in this Statement, HUAWEI’s practice is to not disclose personal information about you outside of HUAWEI and its affiliates without your consent. HUAWEI may disclose the personal information described in Section 2 of this Statement to its third party service providers (which are obligated to maintain confidentiality and security of the personal information and are restricted from using such information other than as authorized by HUAWEI or as otherwise permitted by law) so they may complete transactions or perform services on HUAWEI’s behalf, transactions on your behalf, or transactions related to providing services to you. For example, HUAWEI may contract with third parties to host the Site, collect and provide product reviews, provide promotions or surveys, send HUAWEI’s emails, and fulfill promotions. However, HUAWEI will restrict those third parties to using the information in connection with the services they provide. HUAWEI may also disclose personal information to comply with the law and lawful requests or legal process, protect the rights or property of HUAWEI and its customers, and when HUAWEI believes in good faith that the disclosure is necessary to protect the personal safety of HUAWEI, its employees and customers, or the public. Also, HUAWEI may disclose personal information in connection with (but not limited to) the following circumstances:

• Certain Business Transfers. HUAWEI may disclose personal information as part of a corporate business transaction, such as a merger or acquisition, joint venture, corporate reorganization, financing, or sale of company assets. HUAWEI may also disclose personal information in the event of insolvency, bankruptcy, or receivership in which personal information could be transferred to third parties as one of the business assets in the transaction.

• Co-Branded Services. Some services in connection with the Site may be co-branded and offered together with another company. If you register for or use these services, both HUAWEI and the other company may receive your personal information collected in connection with the co-branded services.

• Other Purposes. HUAWEI may disclose personal information as consented to by you from time to time, including fulfilling any other purposes that are identified when the personal information is collected.

HUAWEI will not use or disclose personal information for purposes other than those for which it was collected, except with your consent or as required or permitted by law. Consent may be express or implied, and given in writing, by using or not using a check-off box, electronically, orally, or by your conduct, such as use of services or products.

4. Children Under Age 13.

The Site does not target and is not intended for children under the age of 13. HUAWEI does not want to collect personal information from children under the age of 13. If you are under 13, do not provide HUAWEI any information about yourself, including your name, address, telephone number, or email address (directly, or on site bulletin boards, blogs, etc.). If HUAWEI discovers personal information from children under age 13, HUAWEI will delete that information.

5. Email Preferences.

You may opt-out of receiving future marketing emails from HUAWEI by following the instructions in email. If you opt-out of receiving future marketing emails, HUAWEI may still send you service communications such as (but not limited to) support and security updates and product recall information.

6. Access and Updates to Personal Information You Submit.

You may be able to update your personal information through the Site by updating registration information you provide in connection with the Site. You will be required to sign in with your user name and password. HUAWEI does not maintain all personal information it collects in a form that can be accessed or updated by you. HUAWEI may keep records of changes to your personal information (including deletions).

7. Security of Personal Information.

HUAWEI is committed to protecting the security of your personal information. HUAWEI and the vendors that provide hosting services for the Site use a variety of security technologies and administrative procedures to help protect your personal information from unauthorized access, use or disclosure with security measures appropriate to the sensitivity of the information. For example, your personal information is stored on computer systems located in controlled facilities. Internal access to users’ private and non-public personal information is restricted to Site administrators and others on a need-to-know basis.

8. Other Applicable Terms.

This Statement only governs the collection and use of personal information collected through the Site. This Statement does not modify or alter other agreements you may have, or enter into later, with HUAWEI. For example, HUAWEI’s Terms of Use only govern your use of the Site. You may provide personal information to HUAWEI through other means, such as when you call customer service or send personal information related to promotions or product registrations via postal mail. In such instances, this Statement does not apply to your submission of personal information to HUAWEI via postal mail.

9. Changes to this Statement.

This Statement is effective as of the effective date at the top of this Statement. HUAWEI may periodically update this Statement to reflect changes in its practices or applicable laws or regulations. If HUAWEI updates this Statement, HUAWEI will post the updated version of this Statement and it will change the “effective date” at the top of this Statement. If the updated version of the Statement contains material changes to how HUAWEI collects, uses, or shares your personal information, HUAWEI will post a prominent notice of the updated version on the Site or send you an email. Your continued use of the Site constitutes your binding acceptance of the updated Statement.
